No Maslaxa System For Our Son’s Attempted Murder, Says Family
Idris Muktar’s family has refused the use of Maslaxa system to resolve the case surrounding the attempted murder of their son. Maslaxa is the traditional dispute resolution mechanism used to resolve cases away from the conventional court system. Few months ago, after a girl was allegedly gang raped in Wajir County, the Interior CS Fred Matiangi warned chiefs against using it to resolve rape cases and threatened the sack for its use.
Some of Mr Idris’s family members reported an attempt by some clan elders to take their case through the Maslaxa mechanism which the family has vowed not to entertain.They demand full justice for their son who is currently fighting for his life.
Maslaxa dispute resolution system has served traditional societies very well over the years but is said to have become a subject of abuse by the rich and famous over the last decade. It has lost some of its glamour after some committee members involved in its implementation has been accused of bias and unethical partiality. Traditionally, the system does not include women in its composition, a point many female activists have questioned particularly where plaintiffs are women.
